I didnt find out till the day of the auction sale date on jan,14 2010 that my house was for sale.?

The bank bought back my house at a foreclosure auction on jan 14, 2010. They didnt send me a letter or put a letter on my door telling me about the auction date. Everything that I have read tells me that the bank needed to tell about the sale date ahead of time. Im still in my house know. Still no word from the bank. What options do I have?I also lost my job. Should I get a lawyer? I long can I stay in the house? When will a eviction letter show up? Some people tell me that they will give me 30 days to move out once the letter shows up, some people tell me 24 hrs once the letter shows up. What is the law in denver, colorado? In the foreclosure law summary it states that the public trustees office must also mail at lease 21 days before the foreclosure sale date a letter letting the homeowner know about the sale date. This didnt happen. There was no notifcation about a jan 14 sale date.

  1. You need to go to the county clerks office and look at the filing. It does not make sense that both the bank and the courts would fail to do what was required. You should have started hearing from the bank as soon as you started refusing to repay them their money.
  2. I bet you are going to have to get a lawyer if you want to fight this. But I have seen some mortgage companies screw up a foreclosure. The house next to me was foreclosed -the people evicted and put up for sale on the MLS. When they found a buyer and went to title company they found they had messed up and had to re- foreclose. It took about three more months.
  3. You can hire a lawyer and may require the bank to go through the process again, however the outcome will still be the same, that you lose the house. Since you have no income and have not been making the payments for probably six months or more....basically living for free all that time, does it make sense to pay a lawyer at least $1000 to delay the process? They have to give you a 30 day notice before they start the eviction process.
