Do I have to pay my broker if I make a profit assigning a contract for real property?
Does the broker get any monies from me for assigning a real estate contract between two private parties in which I don't have a buyers agreement or listing agreement? ( California )

- Wait a second. If you don't have a written agreement between you and the broker, then under the statute of frauds you shouldn't owe any money. However, an agency contract can be created if certain verbal agreements were made and the actions taken by the broker were consistent with those.
- No, you the investor, don't pay anything to the broker because the property hasn't close escrow. The broker's commission is negotiate being them and the Seller (Owner/Lender). You're only selling a contract to another End Buyer or Investor at a premium for the price that you lock the property in at with the Seller. Broker/agent doesn't earn their commission from the Seller until the deal is over & done with.
