what happens to real property and assets of a individual who is in this state illegally?

Individual has been in this country illegally for the last 20 + years, all children(under aged) and born in this country? Had deportation order. Ownes 750,000.00 home.....

  2. All assets can be confiscated to pay for deportation, etc. If he has deportation order, he should get passports for his kids at his country's consulate so he can take them with him. Any child has a right to citizenship in its parents' country of citizenship, so they go with him without any immigration hassles -- all he has to do is get them passports to his country.
  3. What should happen is that the state should take possession of it in order to defray the costs connected with illegal aliens. What does happen is that when he is deported and payments are no longer made on the house or on the taxes for the house, it will be foreclosed on and sold.
  4. I believe he will lose it. It represents ill gotten gains and as such, forfit.
  5. if his house is paid for nothing happens to his assets; as long as he can pay for the cost of his trip back to his country and any immigration penalty it may be applied... if he holds a mortgage he also has a good reason to find a lawyer and contest his deportation or delay it since he has financial obligations to settle before he can leave... If his children are americans (I am assumed since they are all under aged and he has been there for 20 years) it is a good chance a good lawayer can postpone his deportation until one of his children is at the right age to claim him through an I-130 petition, with a pending petition he no longer have to leave.
