Who should sign to list real property?

Is only the executrix of an estate required sign in order to list real property for sale with a real estate agent?

  1. All parties who are present on the title and the deed are required to sign.
  2. I would recommend you to download a very useful For Sale By Owner guide on the web-site of Fizber, which will help you to understand how the real estate market works: http://www.fizber.com/static/pdf/sellers_guide.pdf

  4. The people who hold the legal right to sell the property are the ones who needs to sign the papers to list. If a husband and wife own the home then both need to sign, but if only one of them is on the deed then they are the only one needed. If you are the person that is mentioned in a will to handle the sale of the property of a deceased person then you are the one needed to sign to list. Now if there are other people who are mentioned in that will along with you then they would be needed to sign.
  5. In the case of an estate, only the executor/trix is required to sign the listing papers. Estates are different scenarios from typical sales because the owners are deceased, so the executrix acts on their behalf legally.
